Mr. McGaha obtained a ruling that DNF Associates, LLC, violated the Fair Debt Collection Practices Act and the Arkansas Fair Debt Collection Practices Act, when it contacted his client, Stephanie Reygadas, to “settle” a debt after DNF Associates LLC, knew Mr. McGaha represented her. Reygadas v. DNF Associates LLC, 2019 WL 2146603 (W.D. Ark., May 16, 2019).

Mrs. Reygadas agreed to take a Judgment against DNF Associates for $4,000.00 in actual and statutory damages under the Fair Debt Collection Practices Act and the Arkansas Fair Debt Collection Practices Act. The Court also ruled that DNF Associates LLC should pay Mrs. Reygadas’ attorneys fees costs in the amount of $22,000. Reygadas v. DNF Associates LLC, 2019 WL 7116357 (W.D. Ark., Dec. 23, 2019).

DNF Associates LLC has appealed the Court’s decision that it violated the FDCPA and the AFDCPA to the Eighth Circuit Court of Appeals.
